Businessman Jimi Wanjigi was released on a personal bond of Ksh10 million after being arrested and held at Kamukunji Police Station on Monday. On Tuesday, Wanjigi appeared in court, where he was ordered to surrender his passport. A ruling is expected on September 12 to determine whether he will be required to enter a plea. On the same day, Wanjigi and a co-accused will learn if the charges against them will be dismissed.
During the court session, Wanjigi’s legal team sought a postponement of the plea. Senior Counsel Paul Muite argued that a previous court order prohibited the police from arresting Wanjigi and required his release if he had already been detained. Muite emphasized that the police acted in contempt of this order by detaining Wanjigi.
The legal dispute also involved allegations of illegal firearm possession. Muite claimed that the police acted maliciously by cancelling Wanjigi’s firearm license, which the High Court had reinstated. Lawyer Wallis Otieno further elaborated that the Firearm Licensing Board revoked Wanjigi’s license again just to charge him with illegal firearm possession.
Otieno also argued before Presiding Magistrate Susan Shitubi that the charges against Wanjigi were fundamentally flawed, as the arrest violated the court’s orders. He pointed out that Wanjigi had been detained despite voluntarily responding to a police summons to appear before the Directorate of Criminal Investigations (DCI).
Additionally, Otieno raised concerns about the treatment of the second accused, Kibe, who was reportedly subjected to physical abuse by police officers while in custody. Otieno alleged that Kibe suffered pain after the police squeezed his genitals.
As the case proceeds, all eyes are on the September 12 ruling, which will determine the next steps in this high-profile legal battle.
